POLICIES FOR USE OF SERVICES

INTRODUCTION

At Explorinka we care about your experience from beginning to end, that is why we feel the need to mention our policies for the use of our services, to clear any doubt you may have. Additionally, we want to offer you security and guarantee at the moment of acquiring our services.

1. Acceptance of Terms and Conditions

By using the services offered by Explorinka, you accept the terms and conditions set forth in this document. If you do not agree with any of these terms, we recommend that you do not use our services.

2. Reservations and Payments

2.1. To reserve any of our bicycle tours, a 50% advance payment is required to guarantee your spot on the tour. Also, consider paying the remaining balance once you are in Cusco. You can do this during the briefing or pre-tour information session.

2.2. Payment by VISA or MASTERCARD credit card through our system www.cuscoperu.com/payment. The system charges an additional 5% (secure SSL system and foreign bank transfer fees).

Payment via Western Union in the name of our representative: CARLOS ALBERTO POLAR AIQUIPA - ID: 29691237 - City: Cusco - Peru. You must send us the MTCN code of your deposit.

Payment via deposit to our company's account at BBVA Banco Continental Checking Account: Interbank Account Code (CCI) 011 201 000100028495 18 - CUSCOPERU.COM E-COMMERCE SRL - SWIFT CODE: BCONPEPL - you must add U$60.00 which is the fee our bank charges to our account for international transfers and administrative expenses, you should also check with your bank for any additional fees they may charge.

Payment by VISA - MASTERCARD credit card using the PAYPAL system by generating a payment order that CuscoPeru.com e-commerce would send you. If you choose this option, there will be a 7% surcharge.

3. Cancellations and Refunds
3.1 Changes to date and departure times
In case of changes to date and departure times, these can only be made 72 hours before your service. You must communicate your request via email, detailing your request, and then our staff will evaluate the changes.
3.2 Tour cancellations
The client reserves the right to cancel the tour for personal reasons or situations in which they consider they cannot carry out the activity. Explorinka will not refund the 50% advance payment, as this cost is considered an operational and administrative expense.
3.3 Cancellations due to weather conditions
Explorinka prioritizes the safety of our clients, so our team is always monitoring the weather conditions. Therefore, the tour may be canceled in the following situations:

  1. Electrical storms:

If during your experience the guide observes an approaching electrical storm, the tour may be canceled, or depending on the situation, the guide may decide to change the itinerary to protect your safety and physical integrity.

  1. Torrential rains

In case of torrential and intense rains, the tour may be canceled. For your safety and depending on the situation, the guide may decide to change the itinerary or cancel the tour.
4. Safety and Travel Assistance
4.1 Liability Release Letter
Our bicycle experiences carry some degree of risk of accidents, so you must follow the pre-tour instructions from our guides. Additionally, you must sign a liability release form that will be provided at the time of booking.
Explorinka is not responsible for any accidents, injuries, damage, or loss of property that may occur during the tour. Participants accept to participate in the tours at their own risk.
4.2 Medical Support
Explorinka has medical support in case of accidents. If an accident occurs during your experience, Explorinka will contact our medical support to assist you and transport you to the nearest clinic. The costs for medical support are not included in the tour. You will have to pay for any medical assistance required in case of an accident.
5. Participant Conduct
5.1 Safety during the tour

  1. During your experience, the Explorinka team will be concerned about your safety, so you must always use the protective equipment provided (helmet, knee pads, elbow pads, gloves).
  2. All participants in our bicycle tours are expected to follow the guide's instructions and respect local laws and regulations at all times.
  3. Explorinka reserves the right to deny participation in a tour to anyone who, at its discretion, poses a risk to the safety or enjoyment of other participants.

5.2 Use and condition of bicycle
Explorinka provides you with a bicycle in perfect working condition. If you find any defects, immediately inform your guide. Follow the guide's instructions for proper use of the equipment. In case the bicycle is damaged due to failure to follow these instructions or performing maneuvers not supported by the bicycle, you will be charged extra fees proportional to the value of the damage caused.
6. Applicable Law
These terms and conditions are governed by the laws of Peru, and any disputes arising in relation to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Cusco, Peru.
By using the services of Explorinka, you acknowledge that you have read, understood, and accepted these terms and conditions in their entirety.
