1. Acceptance of Terms and Conditions
By using the services offered by Explorinka, you accept the terms and conditions outlined in this document. If you disagree with any of these terms, we recommend that you do not use our services.
2. Reservations and Payments
2.1. To reserve any of our bike tours, a 50% advance payment is required to guarantee your spot on the tour. Additionally, consider settling the remainder of the payment once you are in Cusco. You may do this at the briefing or pre-tour information session.
2.2. Payment via VISA or MASTERCARD credit card through our system www.cuscoperu.com/payment. The system charges an additional 5% (SSL secure system and foreign bank transfer fees).
2.3. Payment via Western Union in the name of our representative: CARLOS ALBERTO POLAR AIQUIPA - ID: 29691237 - City: Cusco - Peru. You must send us the MTCN code of your deposit.
2.4. Payment via deposit to our company's account at BBVA Banco Continental Current Account: Interbank Account Code (CCI) 011 201 000100028495 18 - CUSCOPERU.COM E-COMMERCE SRL - SWIFT CODE: BCONPEPL. You must add U$60.00 to cover our bank’s international transfer fee and administrative costs. You should also check with your bank for any additional fees they may charge.
2.5. Payment via VISA - MASTERCARD credit card through the PAYPAL system, generating the payment order that we would send you from CuscoPeru.com e-commerce. If you choose this option, there will be a 7% surcharge.
3. Cancellations and Refunds
3.1 Changes to dates and departure times
In case of changes to dates and departure times, they can only be made 72 hours before your service. You must contact us via email detailing your request, and our staff will evaluate the changes.
3.2 Tour cancellations
Customers may cancel the tour for personal reasons or situations that prevent them from participating. Explorinka will not refund the 50% advance, as this cost is considered an operational and administrative expense.
3.3 Cancellations due to weather conditions
Explorinka prioritizes the safety of our clients, so our team constantly monitors the weather. The tour may be canceled in the following situations:
a. Thunderstorms: If the guide observes an approaching thunderstorm during the tour, the tour may be canceled, or depending on the situation, the guide may decide to change the itinerary to protect your safety and physical well-being.
b. Heavy rain: In the case of intense, heavy rain, the tour may be canceled. For your safety, and depending on the situation, the guide may decide to change the itinerary or cancel the tour.
4. Safety and Assistance During Your Trip
4.1 Liability Waiver
Our bike tours carry a certain degree of accident risk, so you must follow the pre-tour instructions given by our guides. Additionally, you will be required to sign a liability waiver provided at the time of booking.
Explorinka is not responsible for any accidents, injuries, damages, or loss of property that may occur during the tour. Participants agree to participate in the tours at their own risk.
4.2 Medical Support
Explorinka provides medical support in case of accidents. If an accident occurs during your experience, Explorinka will contact our medical support team to assist you and transport you to the nearest clinic. The costs of medical assistance are not included in the tour. You will be responsible for covering medical expenses in case of an accident.
5. Participant Conduct
5.1 Safety during the tour
a. During the tour, the Explorinka team will prioritize your safety, so you must always wear the protective equipment provided (helmet, knee pads, elbow pads, gloves).
b. All participants in our bike tours are expected to follow the guide's instructions and comply with local laws and regulations at all times.
c. Explorinka reserves the right to deny participation in a tour to anyone who, in our judgment, poses a risk to the safety or enjoyment of other participants.
5.2 Bicycle Use and Condition
Explorinka will provide you with a bicycle in perfect working condition. If you find any defects, please immediately inform your guide. Follow the guide's instructions on the proper use of the equipment. If the bicycle is damaged due to failure to follow these instructions or by performing unsupported maneuvers, additional charges proportional to the damage will apply.
6. Governing Law
These terms and conditions are governed by the laws of Peru, and any disputes arising in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts in Cusco, Peru.
